The Novartis Supreme Court case is the final act in a legal battle that stretches back six years over India?s future capacity to produce low-cost generic medicines for its people, and for patients in other developing countries. WHAT NOVARTIS SAYS:
NOVARTIS: Gleevec will continue to be (generically) available under the transition clause in the Indian patent law regardless of the legal outcome of our case.

NOTE: Novartis is referring to the transition clause which is also known as the ?automatic licensing? clause in India?s patent law. This means that Indian companies already producing a generic version of a drug?if this production began before 1 January 2005?do not have to negotiate for a voluntary license or request a compulsory license from the government but can continue to produce the product, provided a ?reasonable royalty? is paid to the patent holder.

BUT if imatinib can still be produced generically ? providing a ?reasonable royalty? is paid ? what?s the concern?
Response from public interest groups:
1. If Novartis does finally manage to obtain a patent in India, by having managed to change the law, production of generic versions of imatinib by companies that do not already produce it may no longer be possible.
2. Even for companies who already produce generic versions of imatinib, there are still many concerns. Section 3(d) of the law specifies that new forms and new uses of known substances cannot be patented, unless they demonstrate a significant increase in efficacy.
2005 ? India?s patent office starts examining patent applications on medicines including Novartis?s patent application for imatinib mesylate.
January 2006 ? Novartis?s patent application on imatinib mesylate (Gleevec) is rejected by an Indian patent office on several grounds, including on Section 3(d) that it is simply a new form of a known substance.

Spain fends off claims to shipwreck's treasure

On Monday, Spain's education, culture and sports minister, Jose Ignacio Wert, told a packed news conference the final U.S. court ruling stated that "the legacy of the Mercedes belongs to Spain."

None of the treasure itself was displayed at the news conference, just a few photos on a TV screen. One showed a white plastic laundry-basket type container full of dull, crud-covered silver coins, large and thin.

After two centuries under water, parts of the trove of coins are stuck together in big chunks, sometimes in the very shape of the chests or sacks they were originally stored in, said Milagros Buendia, part of the specialized team that went to Florida to get the booty.

Wert said Spain will now set about classifying and restoring the 594,000 coins and other artifacts involved before it figures out how to display them for the public.

"It will thus be a fairly complex job and is going to take some time," Wert said.

At the time of their discovery, the coins were estimated to be worth as much as $500 million (euro300 million) to collectors, which would have made it the richest shipwreck haul in history.

Spain says the Mercedes had more than 200 people aboard when it exploded and sank in 1804 in a naval battle with the British.

Spain went ahead and transported the treasure from Florida despite a last-ditch, longshot claim to the treasure by Peru.

On Thursday, the Peruvian government made an emergency appeal to the U.S. Supreme Court seeking to block transfer of the treasure to give Peru more time to make arguments in U.S. federal court about its claim to being the rightful owner. But that appeal was denied Friday by U.S. Supreme Court Justice Clarence Thomas.

Peru had argued the gold and silver on the ship was mined, refined and minted in its territory, which at the time was part of the Spanish empire.

But Carmen Marcos, deputy director of Spain's National Museum of Archaeology, said Monday the coins were minted not just in Peru but also in Bolivia, Colombia and Chile. And the whole affair involved in claiming the coins was not about monetary value but rather history, she added.

"These coins are not money. They are archaeological pieces," she told reporters.

Pygmy goats can develop "accents" as they grow older, according to scientists.

The young animals, known as "kids", are raised in groups or "creches" with goats of a similar age.

Researchers found that when young goats mixed in these social groups their calls became more similar.

The animals join an elite group of mammals known to adapt a vocal sound in response to the environment that includes humans, bats and whales.

Dr Elodie Briefer and Dr Alan McElligott from Queen Mary's School of Biological and Chemical Sciences at the University of London, UK published their results in the journal Animal Behaviour.

In order to test the goats' vocal repertoire they recorded calls at one-week-old and again when they were aged five weeks.

"Five weeks corresponds to the time when, in the wild, they join their social group after spending some time hidden in vegetation to avoid predators," Dr Briefer explained.

"We found that genetically-related kids produced similar calls... but the calls of kids raised in the same social groups were also similar to each other, and became more similar as the kids grew older."

"This suggests that goat kids modify their calls according to their social surroundings, developing similar 'accents'."

Dr Briefer suggested that the social structure of the goats could be the motivator behind the convergence in calls.

"This could act as a 'group member badge' allowing them to identify members of the group, differentiate them from members of other groups, and increase group cohesion," she told BBC Nature.

"This is especially important in goats, because they live in complex social groups that split during the day and come back together at night."

Scientists suggest that the ability to modify a sound rather than making calls limited by genetics could be more widespread than previously thought.

WASHINGTON (AP) ? Defense Secretary Leon Panetta is defending his department's slimmed-down, $614 billion budget plan, telling senators that it is time to step up and show they are serious about reducing the deficit.

"It was this Congress that mandated, on a bipartisan basis, that we reduce the defense budget, and we need your partnership to do this in a manner that preserves the strongest military in the world," Panetta said in the written testimony, which was obtained by The Associated Press. "This will be a test of whether reducing the deficit is about talk or action."

Defense officials have laid out plans to find about $260 billion in savings over the next five years, including moves to slash the size of the Army and Marine Corps, cut back on shipbuilding, and delay the purchase of some fighter jets and other weapons systems.

The plan also slashes war spending. Money for Iraq and Afghanistan will drop from $115 billion this year to $88.5 billion, with less than $3 billion spent for security in Iraq. It also cuts in half the amount spent on training and equipping Afghanistan's security forces, a crucial element to the U.S. effort to withdraw forces gradually and transfer security responsibility to the Afghans.

While military personnel still would get a 1.7 percent pay raise, retirees would get hit with a series of increases in health care fees, copays and deductibles. The impact would be greater on those who are under 65 and are likely to have another job, as well as on those who make more money.

Senators also complained Monday that President Barack Obama and his defense team have made no plans to deal with an additional $492 billion in across-the-board military cuts that will occur in January 2013 if Congress does not act to avoid them.
